These Terms and Conditions govern access to and use of the website madeiravillarentals.com, as well as accommodation bookings and other services made through it.

By using this website and, in particular, by completing a booking, the user declares that they have read, understood and accepted these Terms and Conditions and the specific conditions of the selected rate.

1. OPERATOR IDENTIFICATION

Hereinafter referred to as “Madeira Villa Rentals”, “we”, “us” or the “operator”.

2. PURPOSE

These Terms and Conditions set out the rules applicable to:

• use of the website madeiravillarentals.com;
• availability searches and bookings made through the website;
• the contracting and payment of stays at Madeira Villa Rentals;
• use of the accommodation units, facilities, equipment and common areas; and
• the contracting of any additional services made available by Madeira Villa Rentals.

The specific conditions shown during the booking process, including price, dates, occupancy, cancellation, prepayment and other characteristics of the selected rate, form an integral part of the booking contract.

If there is any inconsistency between these Terms and the specific conditions of a particular rate or booking, the specific conditions shown to the guest before the booking is confirmed shall prevail, except where mandatory law provides otherwise.

3. BOOKING ENGINE

The website uses technology provided by Ynnov for, among other functions, displaying availability and managing and processing bookings.

Use of this technology does not change the identity of the accommodation service provider.

Unless expressly stated otherwise, the accommodation contract resulting from a booking made through madeiravillarentals.com is entered into directly between the guest and JOÃO GAMA & RODRIGUES, UNIPESSOAL, LDA.

Ynnov acts as a technology service provider and not as the provider of the accommodation.

Certain operations, including electronic payments, may be carried out through external providers duly integrated with the booking engine.

4. BOOKING PROCESS

To make a booking, the user must select through the booking engine:

• the required dates;
• the accommodation unit;
• the number and, where requested, the ages of the guests;
• any additional services;
• the preferred rate; and
• an available payment method.

Before the booking is completed, the total price or the method used to calculate it, the payment conditions and the applicable cancellation conditions will be displayed.

The user is responsible for carefully checking the information entered and the rate conditions before confirming the booking.

A booking is considered confirmed once a booking confirmation has been issued, normally by email.

A mere availability search or commencement of a booking process does not guarantee accommodation availability.

5. BOOKING HOLDER AND MINIMUM AGE

The booking holder must be at least 18 years old and have legal capacity to enter into the contract.

The minimum age for check-in is also 18.

The booking holder is responsible for:

• the truthfulness and accuracy of the information provided;
• compliance with these conditions;
• the persons included in the booking; and
• the conduct of the other guests during the stay.

Where required to comply with legal obligations, identification documents and other guest information may be requested.

6. ACCOMMODATION UNITS AND OCCUPANCY

Madeira Villa Rentals markets different accommodation units, each with its own characteristics, capacity, equipment, amenities and specific rules, as described on the website, during the booking process and in the booking confirmation.

A booking grants the guest the right to use the specifically selected unit and only the spaces, equipment and amenities stated as included in that booking.

The maximum occupancy is the occupancy stated for the selected unit during the booking process.

Persons not included in the booking may not stay overnight or remain at the property without prior authorisation from Madeira Villa Rentals.

7. PRICES

All prices displayed on the website are expressed in euros (€).

The price applicable to the stay is the price displayed during the booking process, taking into account:

• the selected dates;
• the accommodation unit;
• the number and ages of guests;
• the selected rate;
• additional services; and
• any applicable promotions.

Taxes legally included in the price will be presented in accordance with applicable law.

Municipal or tourist taxes which are legally charged separately may be added to the booking price.

8. MUNICIPAL TOURIST TAX

The application of a municipal tourist tax depends on the municipality in which the booked unit is located and on the municipal rules in force on the date of the stay.

As at the date of the latest update of these Terms and Conditions, Vila Escaleiras and Villa Domoterra I, located in the Municipality of Porto Moniz, are not subject to a municipal tourist tax currently in force.

Villa Espigão, located in Fajã da Ovelha in the Municipality of Calheta, is subject to the Calheta Municipal Tourist Tax. The amount currently applicable is €2 per guest per night, up to a maximum of 7 consecutive nights per person per stay.

Guests under 13 years of age and any other cases covered by the exemptions in the applicable municipal regulation are exempt. The tax may be charged separately from the accommodation price.

If any municipality changes, introduces or repeals a tourist tax, or changes its amount, scope, limits or exemptions, the legal rules in force on the date of the stay will apply.

9. PAYMENTS

The payment methods actually available will be shown to the user during the booking process.

Depending on the selected rate, the following may be required:

• full payment at the time of booking;
• partial payment or a deposit;
• payment at a later date; or
• another payment arrangement expressly indicated during the booking process.

Where payment is processed through an external provider, that provider’s security measures and, where relevant, its terms will apply.

A booking may be cancelled if a payment due is not made within the stated deadline.

Payment conditions used by Booking.com or other external platforms apply exclusively to bookings made through those platforms and not to bookings made directly through madeiravillarentals.com.

10. CANCELLATION AND PREPAYMENT

Cancellation and prepayment conditions may vary depending on the accommodation unit, rate, dates, season or selected promotion.

The policy displayed during the booking process and included in the confirmation is the policy applicable to the relevant stay.

Rates may include, among others:

• free cancellation until a specified date;
• partially refundable rates;
• non-refundable rates;
• rates subject to prepayment; or
• special promotional conditions.

Guests should carefully review these conditions before completing a booking.

Where cancellation charges apply, they may be deducted from amounts already paid or charged using the authorised payment method, in accordance with the conditions accepted at the time of booking.

11. BOOKING CHANGES

Requests to change dates, accommodation unit, occupancy or other booking details are subject to:

• availability;
• the conditions of the rate originally selected; and
• the prices applicable to the new requested conditions.

A change will only be considered accepted once confirmed by Madeira Villa Rentals.

12. NO-SHOW

A no-show occurs when the guest does not arrive on the scheduled arrival date without having cancelled in advance.

In the event of a no-show, the conditions of the booked rate will apply and the guest may not be entitled to a refund of amounts paid.

13. RIGHT OF WITHDRAWAL

The general right of withdrawal applicable to certain distance contracts does not apply to contracts for the provision of accommodation for non-residential purposes where the contract provides for a specific date or period of performance, in accordance with applicable law.

Accordingly, an accommodation booking for specified dates does not automatically benefit from a 14-day free cancellation period.

Cancellation is subject to the specific conditions of the selected rate.

14. CHECK-IN

The check-in time applicable to each unit is the time stated during the booking process, in the booking confirmation or in the arrival instructions sent to the guest.

Guests must inform Madeira Villa Rentals in advance of their expected arrival time where requested.

Where available, this may be done through the special requests field in the booking or by email at booking​madeiravillarentals.com.

Arrival requests outside the time stated for the unit are subject to prior confirmation and may be subject to additional conditions.

15. CHECK-OUT

The check-out time applicable to each unit is the time stated during the booking process, in the booking confirmation or in the instructions provided to the guest.

Late check-out requests are subject to availability and prior authorisation and may incur additional charges.

Remaining in the unit after the applicable check-out time without authorisation may result in additional charges.

16. CHILDREN

The policy concerning children, occupancy and ages used for pricing purposes is the policy shown for the selected unit and rate during the booking process.

The correct number of children and their ages must be provided at the time of booking so that the applicable occupancy and price can be calculated.

Any specific age or occupancy restrictions will be presented before the booking is confirmed.

17. COTS AND EXTRA BEDS

The availability of cots, extra beds or other arrangements for children depends on the selected unit and the conditions shown during the booking process.

Where such equipment or services are subject to an additional charge, the amount will be shown during the booking process or communicated before confirmation.

All requests are subject to availability and are only considered accepted once expressly confirmed.

In the absence of an express statement, the availability of cots or extra beds should not be assumed.

18. PETS

The admission of pets depends on the policy applicable to the booked unit, as stated on the website, during the booking process or in the confirmation.

This rule does not affect rights recognised by law in relation to assistance dogs or other legally protected situations.

19. NO SMOKING

Smoking is not permitted inside accommodation units unless expressly stated otherwise. Guests must comply with the specific rules and signage applicable to each property.

Guests must respect any instructions identifying areas where smoking is or is not permitted.

Extra cleaning or repair costs resulting from a breach of this rule may be charged to the guest in accordance with the damage policy and applicable law.

20. PARTIES AND EVENTS

Parties or events are not permitted without the prior express authorisation of Madeira Villa Rentals.

In particular, stag, hen or similar parties are not permitted.

Any event authorised in advance may be subject to specific conditions and charges.

21. QUIET HOURS

Guests must observe the legally applicable quiet periods and any specific rules communicated for the booked unit.

During those periods, guests must avoid noise or conduct likely to disturb neighbours or other persons lawfully using the property.

This rule does not affect any other noise restrictions imposed by applicable law.

22. GUEST CONDUCT

Guests undertake to use the accommodation units, equipment, furniture, garden, swimming pool and other areas responsibly.

Conduct which may do any of the following is not permitted:

• put persons or property at risk;
• cause damage to the property;
• disturb other guests or neighbours;
• breach the law; or
• compromise the safety or normal operation of the accommodation.

In serious cases, Madeira Villa Rentals may terminate the stay, without prejudice to mandatory consumer rights and any liability for damage.

23. FACILITIES, EQUIPMENT AND AMENITIES

The facilities, equipment and amenities available vary by accommodation unit and are those described on the website, during the booking process or in the booking confirmation.

They must be used prudently and in accordance with the safety instructions, rules of use and limitations communicated for each property.

Children must remain under appropriate adult supervision whenever they use equipment or areas requiring supervision.

Guests must not use objects or engage in conduct capable of creating a risk to persons, property or facilities.

For safety, maintenance, weather, breakdown or other justified reasons, a facility, item of equipment or amenity may be temporarily unavailable.

24. OUTDOOR AND USE AREAS

Gardens, terraces, circulation areas, access routes and any other outdoor spaces or areas made available with the unit must be used with care and in accordance with the rules applicable to the property.

Where shared areas exist, they must be used with due regard for other users and do not grant any right of exclusive use unless expressly stated otherwise.

25. PARKING

The existence, location, capacity, conditions and any charge for parking vary by unit and are as stated in the accommodation description or booking confirmation.

Where parking is provided, it does not constitute a vehicle deposit, custody or surveillance service unless expressly stated otherwise.

Guests must use only authorised parking areas and comply with the rules applicable to the property.

26. DAMAGE

Guests are responsible for damage caused by themselves or by persons included in their booking to the accommodation, furniture, equipment or other facilities.

Costs arising from damage, loss, replacement or exceptional cleaning attributable to the guest may be charged in accordance with the damage policy, the booking conditions and applicable law. Where a security deposit or predefined limit applies, the relevant amount will be disclosed before or during the booking process.

Whenever possible, identified damage and the corresponding costs will be communicated to the guest.

This provision does not cover normal wear and tear resulting from proper use of the facilities and equipment.

27. CLEANING AND CARE

Units are provided in appropriate conditions of cleanliness and use.

Guests must keep the accommodation in a reasonable state of cleanliness and care.

The frequency of cleaning, linen changes and other services during the stay depends on the conditions of the unit and selected rate, as stated in the booking or contracted separately.

Costs arising from manifestly abnormal soiling or damage may be charged where duly justified and in accordance with applicable rules.

28. PERSONAL BELONGINGS

Guests are responsible for the proper safekeeping of their personal belongings during the stay.

Madeira Villa Rentals shall not be liable for the loss, theft or damage of belongings where such event is not legally attributable to it.

Items found after check-out may be kept for a reasonable period.

Packaging and shipping costs for forgotten belongings shall be borne by the guest.

29. SERVICES AND SPECIAL REQUESTS

Special requests, including those relating to arrival time, children, accessibility, parking, transfers, equipment or other services, are subject to availability and the characteristics of the booked unit.

Including a request in the comments or special requests field does not automatically mean that it has been accepted.

A service is only considered confirmed once expressly accepted by Madeira Villa Rentals.

Some services may incur additional charges.

30. ACCOMMODATION UNAVAILABILITY

If, due to exceptional and justified circumstances, the booked unit cannot be made available, Madeira Villa Rentals will seek, as appropriate in the circumstances, to:

• provide an alternative unit of equivalent or higher standard;
• propose suitable alternative accommodation;
• allow a change of dates; or
• refund paid services that cannot be provided.

The solution adopted will always take into account the guest’s rights under applicable law.

31. FORCE MAJEURE

Madeira Villa Rentals shall not be liable for delays or inability to perform directly resulting from events beyond its reasonable control, including natural disasters, fires, severe storms, earthquakes, conflicts, acts of public authorities or widespread interruptions of essential services.

This provision does not affect any mandatory rights granted to consumers.

32. WEBSITE OPERATION

Madeira Villa Rentals will seek to ensure the proper operation of the website and booking engine, but cannot guarantee uninterrupted availability or the complete absence of technical errors.

Temporary interruptions may occur due to maintenance, updates, communications, technology providers or other technical circumstances.

Any obvious technical error, including an error concerning price or availability, will be communicated to the user as soon as reasonably possible and an appropriate solution will be sought.

33. THIRD-PARTY LINKS AND SERVICES

The website may integrate or provide links to third-party services, including booking engines, payment systems, maps, social networks or other online services.

Use of those services may be subject to their own terms and privacy policies.

34. INTELLECTUAL PROPERTY

Unless otherwise indicated, the text, photographs, videos, logos, graphic elements, design and other content of madeiravillarentals.com belong to JOÃO GAMA & RODRIGUES, UNIPESSOAL, LDA or are used with the authorisation of the relevant rights holders.

Their reproduction, distribution, alteration or commercial use is not permitted without prior authorisation, except where allowed by law.

Madeira Villa Rentals provides access to the Portuguese Complaints Book in accordance with applicable law.

Consumers may also use the Electronic Complaints Book through the official platform made available for this purpose.

38. ALTERNATIVE DISPUTE RESOLUTION

In the event of a consumer dispute, guests may first contact Madeira Villa Rentals at booking​madeiravillarentals.com.

Without prejudice to recourse to the legally competent courts, consumers may use the competent alternative consumer dispute resolution body.

For the Autonomous Region of Madeira, the Centro de Arbitragem de Conflitos de Consumo da Região Autónoma da Madeira (CACC RAM) may be applicable.

Consumers may consult up-to-date information about alternative dispute resolution bodies through the official channels of the competent authorities.

39. COMPLAINTS RELATING TO THE STAY

Where a problem relating to the accommodation is identified, the guest should, whenever possible, report it to Madeira Villa Rentals during the stay so that it can be assessed and, where possible, resolved.

For this purpose, guests may use booking​madeiravillarentals.com.

This provision does not limit any statutory consumer rights.

40. CHANGES TO THESE TERMS AND CONDITIONS

Madeira Villa Rentals may amend these Terms and Conditions where necessary as a result of legal, commercial, operational or technological changes.

The version applicable to a booking will, in principle, be the version in force at the time the booking was confirmed.

Subsequent amendments will not retroactively affect bookings already entered into, unless they result from mandatory legal provisions.

The date of the latest update will be stated at the beginning of this document.

41. SEVERABILITY

If any provision of these Terms and Conditions is held to be invalid, unlawful or unenforceable, the remaining provisions shall continue in force to the fullest extent permitted by law.

42. GOVERNING LAW AND PREVAILING VERSION

These Terms and Conditions and accommodation contracts entered into through madeiravillarentals.com are governed by Portuguese law.

Disputes shall be submitted to the authorities or courts having jurisdiction under applicable law, without prejudice to mandatory consumer protection rules.

These Terms and Conditions are made available in Portuguese and English. In the event of any discrepancy in interpretation between the two versions, the Portuguese version shall prevail, without prejudice to mandatory consumer rights.
